These Terms & Conditions (“Terms”) govern all use of www.k2-fabrication.com and all purchases from K2 Fabrication, LLC (“Company,” “we,” “us,” or “our”).

By accessing this website, purchasing products, or checking the acceptance box at checkout, you agree to be legally bound by these Terms.

If you do not agree, do not use this website or purchase our products.

1. Eligibility

By agreeing to these Terms, you represent and warrant that:

  • You are at least 18 years old;

  • You are legally capable of entering into a binding contract; and

  • You have authority to agree to these Terms.

2. Electronic Acceptance

By checking the box indicating acceptance of these Terms at checkout, you acknowledge that:

  • You have read and understood these Terms;

  • You agree to be legally bound by them; and

  • Your electronic acceptance constitutes a legally binding agreement equivalent to a handwritten signature.

3. Products & Use

K2 Fabrication, LLC manufactures and sells fabricated components, structural parts, mechanical products, and custom goods.

You are solely responsible for:

  • Determining product suitability

  • Ensuring proper installation

  • Inspecting products prior to use

  • Ongoing maintenance

  • Compliance with all applicable laws and regulations

Custom or made-to-order products may not be cancellable or refundable.

4. ASSUMPTION OF RISK

You acknowledge that fabricated, structural, mechanical, and vehicle-related products involve inherent risks, including but not limited to:

  • Equipment failure

  • Structural failure

  • Vehicle instability

  • Rollover

  • Loss of control

  • Property damage

  • Serious bodily injury

  • Death

You voluntarily and knowingly assume ALL risks associated with the purchase, installation, and use of any product sold by K2 Fabrication, LLC.

5. VEHICLE-RELATED PRODUCTS – OFF-ROAD USE ONLY

UNLESS EXPRESSLY STATED OTHERWISE IN WRITING, VEHICLE-RELATED PRODUCTS ARE INTENDED FOR OFF-ROAD USE ONLY.

You acknowledge that:

  • Products may not comply with federal, state, or local on-road regulations;

  • Installation may void manufacturer warranties;

  • Modifications may affect handling, braking, emissions systems, structural integrity, and safety systems;

  • Modified vehicles may present increased risk of accident or rollover.

You are solely responsible for determining legality and safe operation.

K2 Fabrication, LLC assumes no responsibility for citations, regulatory violations, accidents, injuries, or damages arising from on-road or off-road use.

6. RELEASE AND WAIVER OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY MINNESOTA LAW, YOU HEREBY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS K2 FABRICATION, LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, OR LIABILITIES ARISING OUT OF OR RELATED TO:

  • PRODUCT DESIGN

  • MANUFACTURING

  • SALE

  • INSTALLATION

  • MODIFICATION

  • USE OR MISUSE

  • PRODUCT FAILURE

THIS RELEASE EXPRESSLY INCLUDES CLAIMS BASED ON THE NEGLIGENCE OF K2 FABRICATION, LLC.

This release includes claims for:

  • Personal injury

  • Death

  • Property damage

  • Economic loss

  • Negligence

This release does not apply to willful misconduct where prohibited by law.

7. LIMITED WARRANTY

Limited Warranty Coverage

K2 Fabrication, LLC warrants that its products will be free from defects caused by faulty workmanship for thirty (30) days from the delivery date.

If properly reported within the warranty period and deemed covered, K2 Fabrication, LLC will correct the defective product at its expense.

Warranty claims must be submitted within 30 days to:

Proof of purchase may be required.

Warranty Exclusions

This Limited Warranty does not cover:

  1. Damages caused by improper or abnormal care, use, storage, handling, or installation

  2. Components not manufactured by K2 Fabrication, LLC

  3. Products modified or repaired by unauthorized persons

  4. Products that have rusted, oxidized, or experienced normal wear and tear

This warranty applies only to the original purchaser and is non-transferable.

DISCLAIMER OF ADDITIONAL WARRANTIES

EXCEPT AS EXPRESSLY PROVIDED ABOVE, ALL PRODUCTS ARE PROVIDED “AS IS.”

K2 FABRICATION, LLC DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • ROAD LEGALITY

  • COMPATIBILITY WITH SPECIFIC VEHICLES OR EQUIPMENT

NO ORAL STATEMENT SHALL CREATE ANY WARRANTY.

8. LIMITATION OF LIABILITY

IN NO EVENT SHALL K2 FABRICATION, LLC BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

IF LIABILITY IS FOUND TO EXIST, IT SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless K2 Fabrication, LLC from any claims, damages, liabilities, costs, and attorney’s fees arising from:

  • Your installation or use of any product

  • Your negligence or misconduct

  • Your violation of any law

  • Any third-party claim related to your use

10. TIME LIMITATION FOR CLAIMS

ANY CLAIM ARISING OUT OF OR RELATED TO A PRODUCT OR THESE TERMS MUST BE BROUGHT WITHIN ONE (1) YEAR FROM THE DATE OF PURCHASE, REGARDLESS OF ANY LONGER STATUTORY LIMITATION PERIOD.

11. CLASS ACTION WAIVER

You agree that any dispute shall be brought solely in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

12. WAIVER OF JURY TRIAL

YOU AND K2 FABRICATION, LLC WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR ANY PRODUCT PURCHASED.

13. GOVERNING LAW & VENUE

These Terms shall be governed by the laws of the State of Minnesota.

Any legal action shall be brought exclusively in the state courts located in Sherburne County, Minnesota.

You consent to personal jurisdiction in those courts.

14. No Reliance

You acknowledge that you are not relying on any representations, statements, or warranties not expressly contained in these Terms or in a written agreement signed by K2 Fabrication, LLC.

15. Entire Agreement

These Terms constitute the entire agreement between you and K2 Fabrication, LLC and supersede all prior communications or agreements.

16. Severability

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
